Martin Brothers Motor Company Distance Sales Policy


1.1 If you wish to cancel your order prior to Delivery of the Vehicle you must do so contacting us by emailing or by phone on 0191 4477340 during business opening hours the day before delivery is scheduled. We will give You a full refund of any monies you have paid as soon as reasonably possible (and in any event within fourteen (14) days of cancellation)

1.2 If We contact you to inform you that we do not accept Your Order, as detailedin, then We will give You a full refund of any monies you have paid as soon as reasonably possible (and in any event within fourteen (14) days of cancellation)

1.3 In accordance with Your rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, You have the right to cancel the purchase of the Vehicle within fourteen (14) days of Delivery.

1.4 You do not need to give Us any reason for cancelling Your purchase. This right to cancel does not affect any of Your statutory rights. You will be responsible for informing us of your Cancellation Request.


2.1 If you wish to exercise your right to cancel You must notify Martin Brothers Motor Company of your Cancellation Request in writing by sending an email to We will contact you to acknowledge receipt of your Cancellation Request and make arrangements for Your Order to be cancelled, for the return of Your Vehicle and a refund to be issued.

2.2 We will aim to contact you within 24 hours of having received your Cancellation Request. If you have not received formal confirmation within 24 hours of placing your Cancellation Request then You should contact us by telephone at 0191 4477340.

2.3. Your vehicle must be returned to us within 14 days of your of Our acknowledgement of Your Cancellation Request.

2.4 Your refund will be made within 7 days of the vehicle being returned to our place of business.

2.5 We do not store Part-Exchange Vehicles and will be unable to return your Part-Exchange Vehicle if you exercise your consumer rights or a 14-day cancellation. In this case We will provide You with payment equivalent to the invoiced Part-Exchange Vehicle value, paid into the Bank account of the named person on the invoice only.


3.1 To receive a full refund during the 14-day cancelation period a maximum additional mileage of 50 miles from the recorded delivery mileage is allowed. Any additional mileage recorded at the time of receipt by Us of a rejected Vehiclewill be regarded as excess mileage and will be charged at £1.00 per mile over the 50 mile allowance. This excess mileage charge will be deducted from your final refund amount. If you return the car to us rather than opting for collection, you will not be charged for delivery miles.

3.2 You must ensure the vehicle is taxed and insured until the vehicle is returned to our premises.


4.1 You will be provided with the option to have Martin Brothers Motor Company collect your rejected Vehicle but You will be liable for a collection charge which will be deducted from your final refund. Collection charges are as follows 0-100 miles £200, 101-200 miles £350, 201-300 miles £500, 301-400 miles £650, 401-500 miles £800.


5.1 If You choose to return Your Vehicle to us at Our place of business then We will agree a date and time for the return to take place.

5.2 The Vehicle Condition Liability for the Vehicle remains with You until it is returned to us and one of our agents has signed for acceptance of the Vehicle.The mileage distance from the place of Delivery to Our place of business will not be counted toward any excess mileage charge.


6.1 You are liable for the condition of the Vehicle from the completion of Delivery. If you choose to cancel within the 14 days, the Vehicle Condition Liability remains with You until an authorised employee has signed to accept receipt of the Vehicle from you. Any damage present of the Vehicle which we record on inspection of the returned Vehicle which was not recorded when you accepted Delivery of the Vehicle remains your liability. Any costs for rectificationof this damage will be deducted from your final refund amount

6.2 No refund amount will be made until the vehicle has been inspected and signed for by an authorisedemployee. If we need to make any deductions from your final refund amount, then you will be made aware of that amount prior to the refund.

6.3 The Vehicle must be returned with all keys and documentation provided to you at the time of Delivery. We reserve the right to deduct any costs or associated costs incurred by Us to replace non-returned keys or documentation.

6.4 We will deduct £500 from your total refund, which we will hold pending you returning the most recent V5C registration document to us. We need the V5C to be returned because the value of the Car will reduce without it. You must send the most recent V5C registration document showing you as the registered keeper to Martin Brothers Motor Company, 3-5 Bladen Street, Jarrow, NE32 3HN by recorded delivery within 14 days of you informing us that you wish to return the Car. You will bear the cost of the recorded delivery. The V5C registration document (which includes your name and address and is an official DVLA document) will remain linked with the Car until it is sold and re-registered by a new registered keeper or scrapped. Please note that before being re-registered by a new keeper, the Car may be sold to one or more motor traders who will not be obliged to register as the new keeper of the Car and remove your name and address from the V5C registration document. We do not accept any liability in respect of your personal information contained on the V5C registration document.

6.5Subject to the V5C being received within 14 days of you informing us that you wish to return the Car, we will repay you the £500 we retained as described in section 6.4 within 14 days of us receiving the V5C. If you fail to return the V5C registration document, we may charge you a fee of £500 as the value of the Car will reduce without the V5C registration document (V5C Fee) and we will retain the £500 referred to in section 12.4.4(b) as payment by you to us for the V5C Fee.


7.1 To exercise your right to cancel you are required to provide us with a Cancellation Request either in writing, by email to or by telephone on 0191 4477340.If you request a cancellation via telephone We may require You to provide an additional written confirmation of your request.

7.2 To make a Cancellation request in writing (post or email) please use the following format
